Terms of Service
These Terms of Service ("Terms") govern your use of My-Rx Check (the "Service"), operated by SoftLOGiX, Inc. ("SoftLOGiX," "we," "us"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Effective date: [set before launch]
1. Who may use the Service
The Service is intended for adults (18 or older) in the United States. By using it you represent that you meet these requirements and that the information you enter is your own or that you are authorized to enter it.
2. What the Service is — and is not
The Service is an educational and informational tool. You enter a list of medications, supplements, health conditions and lab values; the Service looks up each drug's official label (as published by the U.S. National Library of Medicine on DailyMed) and related National Library of Medicine data, and shows you the passages that mention the other items on your list.
The Service is not medical advice, diagnosis, or treatment, and it is not a substitute for the judgment of a physician, pharmacist, or other licensed health-care professional. Using the Service does not create a doctor-patient, pharmacist-patient, or any other professional relationship between you and SoftLOGiX. SoftLOGiX does not practice medicine or pharmacy, does not review your list, and does not know your full medical situation.
3. Limits of the check — read this
- It can miss interactions. The check is a text search of drug labels and public reference data, not a curated clinical interaction database. If a label words an interaction differently, or does not mention it, nothing will be shown. No result does not mean no interaction.
- It can show passages that do not apply to you. A quoted sentence may concern a dose, a route, or a patient group that is not yours.
- Severity labels are automated. The coloured stickers reflect the wording and the section of the label a passage came from; they are not a clinician's assessment of your risk.
- Lab ranges are typical values. Reference ranges differ between laboratories; the range on your own lab report governs.
- Data can be out of date or unavailable. Labels change, and the public services the check relies on are sometimes unreachable.
Never start, stop, or change the dose of any medication or supplement because of what the Service shows. Take the report to your pharmacist or prescriber and decide with them. If you think you are having a medical emergency, call 911. For a possible poisoning or overdose, call Poison Control at 1-800-222-1222.
4. Sources
Drug names, ingredients and classes come from RxNorm and RxClass; contraindication relationships from MED-RT; label text from DailyMed; condition codes from the NLM ICD-10-CM search; supplement labels from the NIH Dietary Supplement Label Database. This product uses publicly available data courtesy of the U.S. National Library of Medicine (NLM), National Institutes of Health, Department of Health and Human Services; NLM is not responsible for the product and does not endorse or recommend this or any other product.
5. Your account and security
Sign-in is passwordless: we email a one-time code to verify it is you. You are responsible for maintaining access to the email address associated with your account and for activity that occurs under your account. Notify us promptly of any unauthorized use. We protect your information in transit (HTTPS) and encrypt your lists, name, and email address at rest using AES-256-GCM, with account records keyed by a one-way hash of your email; see our Privacy Policy for details.
6. Subscriptions, billing, and cancellation
- Core features are available to registered users at no charge. Advanced features are available to subscribers.
- New subscriptions may include a free trial, offered once per account; an account that has subscribed before is billed from the start. Unless you cancel before the trial ends, the subscription converts to a paid, recurring subscription billed monthly at the price shown at sign-up (currently $4.95/month), until cancelled.
- Payments are processed by PayPal under PayPal's own terms; we do not receive or store your full card or bank details.
- You may cancel at any time from the Subscribe page. On cancellation you retain access through the end of the current paid billing period, and the subscription does not renew after that. It is your responsibility to cancel before the trial ends or before the next billing date if you do not wish to be charged. Except where required by law, we do not refund charges incurred because a subscription was not cancelled in time, including the first charge at the end of a free trial.
- Except where required by law, payments are non-refundable, and partial billing periods are not prorated. We may change pricing or features prospectively; material changes will be communicated before they take effect.
7. Acceptable use
You agree not to misuse the Service, including by: attempting to gain unauthorized access; copying, scraping, reverse-engineering, or reselling the Service or its outputs on a commercial basis; interfering with its operation or security; using it to make clinical decisions for patients in a professional capacity; entering another person's health information without their permission; or using it in violation of any applicable law.
8. Intellectual property
The Service, including its software, text, and design, is owned by SoftLOGiX and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use. The lists associated with your account remain yours; you grant us the limited rights needed to store and process them to provide the Service. Drug-label text is public U.S. Government information reproduced from DailyMed.
9. Third-party services
The Service relies on third parties, including the National Library of Medicine and NIH (drug data), PayPal (payments), an email provider (verification codes), and Microsoft Azure (hosting). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their acts, omissions, or availability.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any result is accurate, complete, or current.
11. Limitation of liability
To the fullest extent permitted by law, SoftLOGiX and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss, or harm arising out of or relating to your use of (or inability to use) the Service or your reliance on anything it shows, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the six months before the claim, or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold SoftLOGiX harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.
13. Changes to the Service and these Terms
We may modify or discontinue features at any time. We may also update these Terms; when we do, we will revise the effective date above, and your continued use after changes take effect constitutes acceptance. If a change is material, we will make reasonable efforts to notify you.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of Pennsylvania, without regard to its conflict-of-laws rules. The state and federal courts located in that state will have exclusive jurisdiction, except where applicable law provides otherwise.
